{"id":9041,"date":"2020-10-21T16:24:59","date_gmt":"2020-10-21T16:24:59","guid":{"rendered":"https:\/\/www.ginx.tv\/ea-to-face-class-action-lawsuit-over-loot-boxes-in-canada"},"modified":"2024-07-20T18:43:14","modified_gmt":"2024-07-20T18:43:14","slug":"ea-to-face-class-action-lawsuit-over-loot-boxes-in-canada","status":"publish","type":"post","link":"https:\/\/www.ginx.tv\/en\/fifa\/ea-to-face-class-action-lawsuit-over-loot-boxes-in-canada","title":{"rendered":"EA to face class-action lawsuit over Ultimate Team loot boxes in Canada"},"content":{"rendered":"<p>One of the biggest culprits when it comes to loot boxes is most definitely Electronic Arts (EA) and their stable of sports titles and so it comes as no surprise that we&#8217;ve seen several lawsuits against them.<\/p>\n<div id=\"traffective-ad-Content_1_617496\" style=\"display: none;\" class=\"Content_1\"><\/div>\n<p>Individuals are starting to take legal action against developers and publishers who implement loot box systems into their games.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/cdn-cf.ginx.tv\/imgcdn\/06kRJQ6-Ft7kPG1XEFPGqaVN04qGo6Dynz7AO02esNQ\/rs:fill:0:0:1\/g:ce\/aHR0cHM6Ly93d3cuZ2lueC50di91cGxvYWRzL05ld0ZvbGRlci9FQV9sb290X2JveGVzL2ZpZmFfMjFfdWx0aW1hdGVfdGVhbV9wYWNrLmpwZw\" alt=\"EA loot box fifa ultimate team nfl class action lawsuit canada\" width=\"1024\" height=\"576\" loading=\"lazy\"><br \/><span style=\"font-size: 8pt;\">(Picture: EA)<\/span><\/p>\n<p>Earlier this year in California, Kevin Ramirez,&nbsp; <a href=\"https:\/\/www.videogameschronicle.com\/news\/ea-faces-a-class-action-lawsuit-over-ultimate-team-loot-boxes\/\" target=\"_blank\" rel=\"noopener nofollow\">filed a class-action lawsuit over Ultimate Team loot boxes in FIFA and Madden<\/a>, which he claims are violating California gambling laws.<\/p>\n<p>Now EA is facing another class-action lawsuit over loot boxes, this time in Canada.<\/p>\n<p>As spotted by gaming and esports law blog The Patch Notes, <a href=\"https:\/\/thepatchnotes.com\/2020\/10\/19\/class-action-filed-against-ea-in-canada-over-loot-boxes\/\" target=\"_blank\" rel=\"noopener nofollow\">two individuals filed a class-action lawsuit against EA in Canada<\/a>, over the practice.<\/p>\n<p>The lawsuit was filed on 30th September 2020, and plaintiffs Mark Sutherland and Shawn Moore claim that EA is operating &#8220;an unlicensed, illegal gaming system through their loot boxes,&#8221; which is in breach of the Criminal Code and other statutes.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/cdn-cf.ginx.tv\/imgcdn\/FWPk6g_EOpeU8kuVJ0JK9pO0k5rm5fgefEH5y9sI8Zs\/rs:fill:0:0:1\/g:ce\/aHR0cHM6Ly93d3cuZ2lueC50di91cGxvYWRzL05ld0ZvbGRlci9FQV9sb290X2JveGVzL2xvb3RfYm94ZXNfbWFkZGVuLmpwZw\" alt=\"loot_boxes_madden\" width=\"1024\" height=\"576\" loading=\"lazy\"><br \/><span style=\"font-size: 8pt;\">(Picture: EA)<\/span>&nbsp;<\/p>\n<p>Furthermore, they claim that the way loot boxes are being implemented is also breaching several laws and various consumer protection statutes of Canada. This includes things like not publishing the odds of winning rewards in loot boxes and making their use semi-mandatory for progression in their games.<\/p>\n<ul>\n<li><strong>Read more: <\/strong><a href=\"https:\/\/www.ginx.tv\/en\/nba-2k\/nba-2k21-players-outraged-over-unskippable-ads-some-even-reportedly-political\" target=\"_blank\" rel=\"noopener\">NBA 2K21 players outraged over unskippable ads, some even reportedly political<\/a><\/li>\n<\/ul>\n<p>In a filed <a href=\"https:\/\/thepatchnotes.com\/wp-content\/wp-content\/uploads\/2026\/01\/Notice-of-Civil-Claim.pdf\" target=\"_blank\" rel=\"noopener nofollow\">Notice of Civil Claim<\/a> plaintiffs listed over 60 video games that EA has published since 2008 and that involve loot boxes.<\/p>\n<p>Some of the games and series listed are Madden, FIFA, NHL, NBA Live, Mass Effect, Need for Speed, Plants vs Zombies, Battlefield series, and Apex Legends, but also mobile games such as Command &amp; Conquer: Rivals, Star Wars: Galaxy of Heroes, and WarFriends.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/cdn-cf.ginx.tv\/imgcdn\/Y1Bk26s_-ONswgUeEc5Mo93k-YyxXFbMqQHBKsFruyI\/rs:fill:0:0:1\/g:ce\/aHR0cHM6Ly93d3cuZ2lueC50di91cGxvYWRzL05ld0ZvbGRlci9FQV9sb290X2JveGVzL2xvb3RfYm94ZXNfZWEuanBn\" alt=\"loot_boxes_ea\" width=\"1024\" height=\"576\" loading=\"lazy\"><br \/><span style=\"font-size: 8pt;\">(Picture: EA)<\/span>&nbsp;<\/p>\n<p>Moore and Sutherland claim that &#8220;the senior officers and directors of EA were at all times fully aware of the unlawful nature of their enterprise and took active steps to carry it out.&#8221;<\/p>\n<p>&#8220;If all the claims succeed as pled, then, in theory, EA could be forced to pay back everything it&rsquo;s made off loot boxes since 2008.
