Firstly, you must have first purchased the game digitally through the Nintendo eShop to be eligible for a full refund, which is the guaranteed method of getting it. If you purchased a code from another reseller, or store, or bought it physically then you're in hot water, unless your physical game store is willing to refund the game because it is "broken," which is unexpected, then this will likely be a dead end for you.

So let's say you bought the game via Nintendo's eShop, from there, you need to call Nintendo directly and request a refund for Pokémon Scarlet and Violet. Keep in mind that the company is not legally required to offer refunds for the game, but in some circumstances, they might agree to revoke your access to the game and refund the purchase price if you can convince them of your situation and speak to a representative who is sympathetic to your request.
